The U.S. District Court (Boston, MA) today set 18/JUL/2012 for the bench trial to determine the Court's sanction against InnovaSystems, Inc.’s for contempt of court stemming from the company's violation of the permanent injunction the federal court entered against Innova in 2007 for infringing one of Proveris’s SprayVIEW® instrument patents.
2 March 2012 | Case Reopend for Innova's Contempt of Court Actions. As noticed by the U.S. District Court today, the automatic stay in InnovaSystems, Inc.’s bankruptcy case has been lifted allowing the Massachusetts federal court to schedule the trial date for determining the sanction it will impose against Innova for violating the permanent injunction the federal court entered against Innova in 2007 for infringing one of Proveris’s SprayVIEW® instrument patents. The contempt action was automatically stayed when Innova filed for bankruptcy .
24 February 2012 | SprayVIEW® Instrument Patent Valid. All of Proveris’s SprayVIEW® Instrument patents remain valid and in force. While contemnor InnovaSystems, Inc. initiated a reexamination proceeding before the United States Patent and Trademark Office contesting the validity of the patent it was found in 2007 to have infringed, no final decision has been made in that process. The process can take 3 to 5 more years to complete and throughout that time, and regardless of what the final decision may be, the patent at issue remains valid and enforceable.
3 January 2012 | Sanctions Trial for Innova's Contempt of Court Actions to be Scheduled. As ordered by the New Jersey Bankruptcy Court today, effective February 28, 2012, the automatic stay in InnovaSystems, Inc.’s bankruptcy case will be lifted to allow the Massachusetts federal court to schedule the trial date for determining the contempt sanction it will impose against Innova. 27 May 2011 | InnovaSystems, Inc. Appeal Rejected. The U.S. Federal Circuit Court of Appeals rejects InnovaSystems' appeal of the contempt order entered against it. The appeals court rules that the district court must consider sanctions against Innova.
